1. Acceptance of Terms

By accessing our website, using our services, or communicating with our AI systems you agree to be bound by these Terms of Service. If you do not agree please do not use our services.

2. Description of Services

Available 4 U provides AI-powered Digital Front Desk solutions for home service contractors including AI virtual receptionist services via SMS and voice, missed call text-back automation, appointment scheduling and booking management, customer review request automation, workflow and CRM automation consulting, and strategy call consultations. Our primary service area is Odessa and Midland Texas and surrounding Permian Basin communities.

3. AI Services Disclosure

Our services include automated AI systems that communicate with your customers on your behalf. By using our services you acknowledge that AI systems including Anna may respond to your customers via SMS and phone. Anna may initially operate under a demo business name before revealing her AI identity. You are responsible for ensuring your customers receive required disclosures about AI interactions.

4. Client Responsibilities

  • Provide accurate and complete business information
  • Obtain proper written consent from your customers before we contact them on your behalf
  • Comply with all applicable laws including TCPA, CAN-SPAM, FCC regulations, and Texas state law
  • Not use our services for illegal, fraudulent, deceptive, or harmful purposes
  • Maintain a valid and active business license in your service area
  • Notify us immediately of any customer complaints related to our automated systems

5. Payment Terms

  • Service fees are as specified in your signed service agreement or proposal
  • Monthly retainer fees are due on the 1st of each month
  • A 15 day grace period applies before service suspension for non-payment
  • All fees are non-refundable unless otherwise stated in writing
  • Available 4 U reserves the right to modify pricing with 30 days written notice
  • Late payments may incur a 1.5% monthly interest charge

6. Intellectual Property

Available 4 U retains all intellectual property rights to our AI systems, prompts, workflows, and proprietary technology. You retain ownership of your business data, customer lists, and contact information. Custom templates and systems we create for you remain our intellectual property unless explicitly transferred in a signed written agreement.

7. Confidentiality

Both parties agree to maintain strict confidentiality regarding proprietary business information, customer data, pricing, and trade secrets shared during our business relationship. This obligation survives termination of services.

8. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED AS IS AND AS AVAILABLE WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR AI SYSTEMS WILL BE ERROR-FREE OR UNINTERRUPTED. RESULTS MAY VARY BASED ON YOUR BUSINESS, MARKET, AND USAGE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AVAILABLE 4 U SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Available 4 U and its officers, directors, employees, and agents from any claims, damages, losses, or expenses including reasonable attorneys fees arising from your use of our services, your violation of these Terms, or your violation of any third-party rights or applicable law.

11. SMS and Communication Terms

  • By providing your phone number you consent to receive SMS/MMS communications from Available 4 U
  • Message and data rates may apply
  • You may opt out at any time by texting STOP
  • Available 4 U is not responsible for delivery failures caused by your carrier

12. Termination

Either party may terminate services with 30 days written notice. Available 4 U may terminate immediately for material breach, non-payment exceeding 30 days, or illegal use of our services. Upon termination you retain access to your customer data. AI workflows, prompts, and system configurations remain the property of Available 4 U.

13. Dispute Resolution

Any disputes shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Midland, Texas under the rules of the American Arbitration Association. Each party waives the right to participate in class action lawsuits.

14. Governing Law

These Terms are governed by the laws of the State of Texas without regard to conflict of law principles. Venue for any permitted court action shall be Midland County, Texas.

15. Entire Agreement

These Terms together with any signed service agreement constitute the entire agreement between the parties and supersede all prior negotiations, representations, or agreements.
